Rebecca at Wonkette has questions about the dismissal of the Alec Baldwin case. This was my answer:

(IANAL) I think that the reason that the judge dismissed the case with prejudice was because the sheriff’s department and prosecution (the state)“buried”the evidence that the armorer’s father had live ammo that was similar to (and may have been the source of) the ammo that killed the victim and that this was probative (though not necessarily exculpatory) and that this was evidence that the defense absolutely should have had (because it creates a direct link between the source, the armorer, and the gun, that did not necessarily involve Baldwin). I think the reasoning here is that, by withholding important and relevant information from the defense, the prosecution FUBARed the whole case and dismissal was the only option. (If they had withheld this evidence, what else might they have withheld?)

Might this be correct?

I am looking at this from afar, this is a constitutional crisis, the judiciary, legal scholars, congress should be saying that these rulings are unconstitutional and the court is not legitimate. Lower courts should be saying they will not abide by these rules. I’m afraid you are in a very polite civil war and currently the other side is winning!

It certainly is interesting observing the US political and legal experiment from afar!

Is there a possibility of the investigations of Thomas & Alito resulting in any punishments or is it just going to perish from the justices ignoring them as usual?

Another depressing reminder that Merrick Garland is a Republican.

I was in Europe when the "Republican Presidents are Kings" ruling came down. I was dismayed that I heard nothing of protests outside the Supreme Court, at the "Justices'" houses, or anywhere else. Americans are sleep-walking into authoritarianism imposed and facilitated by the Opus Dei wing of the Supreme Court.

Democrats should have introduced legislation expanding the Court in 2021. Special Counsel to investigate the corruption of Thomas and Alito should have been established when the first reports of unreported lavish gifts appeared. Democrats must stop treating the outlandish as politics as usual. Dithering and delaying only has emboldened the Christo-fascists and the authoritarians on the right.

Since we know, as you stated, that AG Garland won't appoint a special counsel, I encourage deep pockets Democrats to hire an army of PI's to comb through EVERY BIT of the life of each of the Opus Dei six, most of the "Judges" on the Fifth Circuit, and Aileen Canon. I have no doubt doing so will turn up information useful to impeaching or otherwise convincing many of them to recuse or retire. If not, President Biden might take the opportunity to use his presumption of immunity for official acts to save America. ;-)
